The Business Freedom Act

Bill XXXX

Purpose

To eliminate business license requirements, affirming that no individual, partnership, or legal entity shall be required to obtain a business license in order to engage in lawful commerce.

BE IT ENACTED BY THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES OF AMERICA IN CONGRESS ASSEMBLED:

Section 1. Title

This Act shall be known and may be cited as the “Business Freedom Act.”

Section 2. Elimination of Business License Requirements

  1. No individual, partnership, corporation, limited liability company, or other legal entity shall be required to obtain or hold a business license from any state or local government—including counties, cities, or municipalities—to engage in lawful business activity.
     
  2. All statutes, regulations, ordinances, or rules, whether state or local, that impose a business license requirement are hereby repealed.
     

Section 3. Consumer Protection and Compliance

  1. The elimination of business licensing requirements shall not affect any existing consumer protection laws, or any health, safety, or environmental regulations designed to prevent fraud, unfair practices, or to ensure public welfare.
     
  2. All businesses must continue to comply with applicable state and federal regulations relating to consumer protection, health, safety, and environmental standards.
     

Section 4. Existing Business Licenses

  1. Any business entity that currently holds a state or local business license may continue to operate without the need for renewal or further compliance with licensing requirements.
     
  2. All existing state and local business licenses shall be considered null and void as of the effective date of this Act.
     

Section 5. Severability

If any provision of this Act, or its application to any person or circumstance, is held invalid, the remainder of the Act—or the application of such provision to other persons or circumstances—shall not be affected.
