To eliminate business license requirements affirming that no individual, partnership, or legal entity shall be required to obtain a business license.
BE IT ENACTED BY THE GENERAL ASSEMBLY
Section 1. Title
This Act shall be known as the "Business Freedom Act."
Section 2. Elimination of Business License Requirements
1. No individual, partnership, corporation, limited liability company, or other legal entity shall be required to obtain or hold a business license from the state or any local government (counties, cities, or municipalities) to engage in any lawful business activity.
2. All statutes, regulations, ordinances, or rules, whether state or local, that impose a business license requirement are hereby repealed.
Section 3. Consumer Protection and Compliance
1. The elimination of business licensing requirements does not affect any existing consumer protection laws, health, safety, or environmental regulations designed to prevent fraud, unfair practices, or ensure public welfare.
2. All businesses must still comply with applicable state and federal regulations related to consumer protection, health, safety, and environmental standards.
Section 4. Existing Business Licenses
1. Any business entity that currently holds a state or local business license may continue to operate without the need for renewal or further compliance with any licensing requirements.
2. All existing state and local business licenses shall be considered null and void as of the effective date of this Act.
Section 5. Severability
If any provision of this Act or its application to any person or circumstance is held invalid, the remainder of the Act or the application of the provision to other persons or circumstances shall not be affected.
